Last night, the Cobell plaintiffs filed their second in a series of at least 50 individual Bills of Particulars in accordance with the March 15, 2002 instructions of Judge Lamberth to clarify the misconduct of Interior, Justice and Treasury officials who have engaged in contemptuous conduct throughout the course of this 6-year, multibillion dollar class-action litigation. This Bill of Particulars clarifies the role of Interior Deputy Associate Solicitor Edith Blackwell in the systematic destruction and cover-up of Solicitor's Office e-mail and other electronic trust records in violation of court orders and in breach of the trust duties owed by the United States to 500,000 individual Indian trust beneficiaries. Plaintiffs have requested that Judge Lamberth enter an order to show cause why Ms. Blackwell should not he held in civil contempt for such conduct. Further, in conformity with the White House crackdown on corporate officers who cook the books of their companies, destroy company records, and mislead their investors, plaintiffs have requested that the Court refer this matter to the U.S. Attorney for the District of Columbia to prosecute Ms. Blackwell for criminal contempt. Elouise Cobell, the lead plaintiff in this action, reconfirmed her commitment to ensure full accountability for ongoing malfeasance in the government's administration of the Individual Indian Trust: "Until the Court places the Individual Indian Trust into receivership, plaintiffs must take whatever action we can to protect our trust ssets from on-going malfeasance in the government's management of the Individual Indian trust. It is an outrage that the White House refuses to hold Interior Secretary Norton and her lawyers to the standards that it demands of corporate CEO's and their lawyers. Because the White House will not cleanup its own house, on behalf of 500,000 individual Indian trust beneficiaries, we will continue to do so with vigor."
